The regular monthly meeting of the Winfall Town Council was held at the Town Hall, on Wednesday, January 9, 2002 , at 7:00 P.M. Those in attendance were Mayor Fred Yates, Council Members, Morris Mitchell, Kenneth Rominger, Alice Rowland, Clifford Towe and Town Attorney, Hackney High. Mayor Yates called the meeting to order. Invocation was given by Councilman Morris Mitchell. The Agenda was approved and adopted with a motion by Councilman Rominger, seconded by Councilman Mitchell, and so carried. The Minutes were approved and adopted with a motion by Councilman Towe, seconded by Councilman Rominger, and so carried. Finances were approved and adopted with a motion by Councilman Rominger, seconded by Councilman Towe, and so carried. |

date.
The
hearing
was
regarding
proposed
changes
to
the
Winfall
Zoning
Ordinance
dated
December
8,
1986.
These
changes
pertained
to
Dimensional
Requirements
for
R-l
Low
Density
Residential
District
and
Dimensional
Requirements
for
Detached
Single
Family
Residence
in
R-2
General
Residential
District.
This
proposal
was
tabled,
pending
a
survey
of
the
dimension
requirements
for
other
towns
the
size
of
Winfall.
NEW BUSINESS Annual Termite Inspection was approved with a motion by Councilman Rominger, seconded by Council Mitchell, and so carried. Resident Jesse Overton was concerned as to when his property would be restored due to sewer construction. Attorney High, explained to Mr. Overton that his complaint has been turned over to the Contractors, T. A. Loving; the ones who caused the damage and are to make the repairs to his property. An investigation of his complaint and complaints made by other residents had merit to them. Therefore we have put the contractors on notice as to the amount of the damage. We have come down to the end of construction and will not be releasing payment for the remaining invoices, until these claims have been satisfied. This is all in accordance with the contract that we have with them. If they do not satisfy the claims, the contract allows us to take the monies we are holding for them, and to settle the claims ourselves. The attorney and the Town have received communications as of this date, that the contractors are willing to work with us. Each of these claims will be handled on an individual basis. Attorney High will be making a copy of this letter with it's settlement offers to the individual claimants. This will give the property owner the opportunity to accept, or to reject the offer; that's being presented to them by the contractor. Mr. Overton was assured that all the complaints he has, will be taken care of. The Fire Chief, Kelvin Roberson, extended an invitation to the Board, to the Fire Department's Banquet, to be held on February 19th. The Beautification Committee was represented, and Mr. Howard Copeland addressed the upcoming project sponsored by the Department of Transportation, of planting Crepe Myrtle and Carolina Beauties within the Town. Mrs. Pat Mansfield, of the DOT was also present to address this endeavor. She affirmed to the residents that the State will cover the cost for this project. However, the Town will be responsible to maintain them after a three year period. Ms. Mansfield presented the Plan for the proposed Highway Landscape Development, showing the areas of the town that will be served by this project. (Tree & Ornamental Plantings NC 37) by the Roadside Environmental Unit of the Department of Transportation, Division of Highways. The project is due to begin this spring and extend through the next three years. Ms. Mansfield suggested that the Town conduct a survey of the residential area involved, before planting trees in front of their property. We can share the plan with them. However, if they do not want the trees in front of their property, the DOT will not do so. The motion to accept this project was given by Councilman Rominger, seconded by Councilman Mitchell and so carried. DEPARTMENT REPORTS Water, Roads and Grounds and Fire Department report was presented by Kelvin Roberson. Police Department Activities were presented by Chief David Shaffer. In addition to the report, Chief Shaffer mentioned that a new law was passed requiring all Law Enforcement Officer to fill our a form called the Traffic Stop Report Form. This is a monthly form required by the State to try to stop profiling. COMMITTEE REPORTS Councilman Rominger presented changes to the Ordinance Establishing A Planning Board, which changed the number of board members from five (5) to seven, and officially mentions members in extraterritorial jurisdiction, which was not mentioned prior to. It also makes note that the Planning Board will also officially act as the Zoning Board. Also a new Ordinance Establishing Minimum Penalty for the Violation of a Town Ordinance When Such Ordinance Does Not Specifically Establish A Penalty For Violation. A motion was made by Councilman Romancer to make changes to the Planning Board Ordinance and to adopt the new Ordinance establishing a minimum penalty for violation of an ordinance, seconded by Councilman Towe and so carried. Perquimans County is one of three counties chosen by the Department of Navy for a proposed landing and lift-off training site. A letter will be drafted to the Department of the Navy, regarding the Town's opposition to this proposal. The Town has been approved for a $328,000 grant and a $175,000 loan for the new Municipal Building. The approval letter has been received from Rural Development. The Wooten Company is working on the drawings and will be presenting them to the Town, very soon. We are half-way through completion of the sewer system. Completion should be sometime near the middle to end of February. Attorney Report was covered with town resident Mr. Overton. Workshop has been postponed for a later date, until the town can get a facilitator. A motion to adjourn by Councilman Towe, seconded by Councilman Mitchell and so carried. |
